Thank you for visiting the Pink Evolution website (the “Site”) of Yantic Limited (“Pink Evolution”). Access to and use of the Site and related services (collectively, the “Services”) are made available to you in accordance with the following Terms of Use & Service and any other rules posted on the Site (collectively, the “Terms Of Service” or “TOS”). By using the Services, such as placing orders on the Site, you are agreeing to all of the Terms Of Service. 

Yantic Limited is a company registered in Hong Kong SAR. Our registered address is Flat /RM 11, 3/F Kinglet Industrial Building, 21-23 Shing Wan Road, Tai Wai, N.T., Hong Kong.

Pink Evolution reserves the right to make any changes on the Site, related policies and agreements, the Privacy Policy and this TOS at any time. You are advised to check the Site from time to time to for the updates or changes to the said policies and agreements, the Privacy Policy and the TOS.

1. Registration 

You are required to register with us when you use the services or place an order. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract.

Where you are required to register, you must:

(i) provide us with accurate, complete and updated registration information;

(ii) safeguard your user name and password; and

(iii) authorize us to assume that any person using our site with your user name and password is either you or is authorized to act for you.

When using the Site, you agree to accept the responsibility for all activities conducted through your account. You are responsible for keeping your account and password secure. If you feel or suspect that the security of your account has been compromised or if there is unauthorized use of your account, please contact us immediately.


2. Order

When you place an order, the prices charged are those applicable on the day you order.

All products on Pink Evolution are listed in Hong Kong Dollars.

Our System will generate an email to the email address registered by customer to confirm that we have received your order. Such confirmation does not constitute a promise of delivery of order items.

We reserve our right not to accept or cancel an order for any reasons at our sole discretion, including without limitation:

- no sufficient stock to deliver the products you have ordered;

- no delivery can be arranged for your area; or

- one or more of the products you ordered was listed at an incorrect price due to a human or computer error or an error in the pricing information provided by the supplier.

 3. Eligibility to Purchase

In order to place orders with us, you must meet our conditions of eligibility:

Be aged 18 years of age or over

Be in possession of a valid credit/debit card issued by a licensed bank acceptable to Pink Evolution for payment or be in possession of a valid PayPal account, unless you have opted to pay in cash on delivery

Providing personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing information and other requested information as indicated on the Site)

In placing an order with us, you authorize Pink Evolution to process a charge or charges on your credit/debit card or PayPal account in the amount of the total purchase price of your order. You also expressly authorize us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including, but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information. Please refer to our Privacy Policy for further information about how we use your data.

All orders are subject to stock availability and confirmation of the order price. Items in your shopping basket are not reserved and may be purchased by other customers.

We will acknowledge your order is confirmed once we have received your order by email. The confirmation will provide:

a) details of what you have ordered,

b) details of the price charged,

c) information about the progress of your order, and

d) estimated dispatch and delivery information.

This communication will be regarded as our acceptance of your order on behalf of the supplier. You may track your order status online.

4. Prohibitions and Failure to Comply

We may take actions against your account for activities including, but not limited to:

Using any technology to attempt to hide the use of multiple accounts or disrupt any of our Services in any way

Initiating communications that contain any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, or racially, ethnically or otherwise objectionable material

Advertising or sending unsolicited messages of any kind

Impersonating others or providing any kind of false information Pink Evolution reserves the right to terminate any account at its sole discretion. We may send you an email to inform you of the termination of your account in such event.

5. Intellectual Property

All software and Content (which is defined as, or includes, any text, audio or music, video, graphics, photographs, and image) are the intellectual property of Pink Evolution and are protected by intellectual property and copyright laws and international treaty provisions. The Site is for your personal and non-commercial use only. Any non-personal and/or commercial use of the Content is only permitted when expressly authorized by Pink Evolution and/or its third party licensors. You may not distribute, reproduce, publish, sell or license any Content contained within the Site without prior consent or authorization of Pink Evolution. Any such unauthorized actions may result in civil consequences or criminal penalties.

6. Third Party Links

The Site may include links to other websites or resources that are not operated or prepared by Pink Evolution. We have no control over such sites and resources and we will not accept responsibility for them or be liable for any loss or damage caused or alleged to be caused by or in connection with your use of them.

Pink Evolution is not responsible for the content or accuracy of any off-Site pages, which include but is not limited to advertisers of the Site. Use of these external websites or resources will be at your own risk and subject to the terms of use and service contained within each of such sites.


7. Product Description

Pink Evolution will endeavour to ensure that the Content and the product descriptions on the Site to be as accurate and complete as possible. We however do not warrant that Content and product descriptions are accurate, complete, current or error-free. Please refer to our Returns policy if you feel a product offered by Pink Evolution is not as described.


8. Pricing

Prices are shown on the Site in Hong Kong Dollars (HKD). Prices displayed on the Site at the time your order is accepted will be honoured except in the case of obvious error. Whilst we use our best endeavours to ensure that all prices appearing on the Site are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors. If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order. If we are unable to contact you, we will treat the order as cancelled.


9. Acceptance of your Order

Once you have entered your personal and payment details and placed your order, we shall send you an email acknowledging the receipt of your order. This email is only a confirmation of receipt of your order and does not constitute an acceptance of your order. Your order will be accepted and the contract between you and Pink Evolution will be completed when we send you an email to confirm the goods have been dispatched to you. Only the goods listed in the confirmation email sent at the time of dispatch are included in the contract formed. All sales contracts are therefore concluded in Hong Kong SAR and are written in Cantonese.

10. Delivery

We offer FREE delivery (single location only) for purchases over HK$400 before using promotion code. For orders under HK$400 before using promotion code, a delivery charge per each order shall apply.

C. Special Delivery Arrangement

· If you need any special delivery needs, please fill in the "Special Requirement(s)" field during your checkout process. Pink Evolution Customer Service Team will contact you and discuss the feasibility and arrangement with you.

· It is the responsibility of you to inform Pink Evolution immediately of any change to your delivery address after placing order.


D. Adverse Weather Arrangement

Delivery services shall delay when typhoon signal, a red or black rainstorm warning is hoisted; or such other weather conditions whereby delivery is considered unsafe. In this event, you will be contacted to re-schedule delivery time


E. General

· We may revise the above terms and conditions at any time without prior notice. If any dispute arises, the company's determination shall be final.

· The company accepts VISA, MasterCard, American Express, and PayPal. Orders will be charged in Hong Kong dollars.

·  Whenever necessary, HKD$0.5 per each plastic shopping bag will be charged in accordance to the Hong Kong regulation.

F. Undeliverable orders

Occasionally orders are returned to us as incorrect address, a PO Box and hotel address, failed delivery attempts, refused to pay tax/ refused to provide ID copy/ inability to make import declarations or parcel refused by recipient.

When the delivery agent returns an undeliverable package to us, we will issue a refund after deducting the original shipping fee, handling fee. 

G. Dispatch Notifications

We will send a Dispatch Notification email on behalf our forwarder to you after the forwarder has dispatched your order. The majority of our orders will be shipped within 1 - 2 business days after the payment is verified. You can expect to receive this email within 1 - 3 business days after you have placed an order. The email contains the details of your shipment as well as a tracking number and link. You can click on the link to track your order.

In case you do not receive the dispatch notification email, your email service provider or email software may have blocked our emails.

H. Tracking orders

Pink Evolution provides you the order tracking service to ensure your confidence.  As a Pink Evolution customer, you will be able to track the status of your order at any time. You may track it by clicking the "Track my Order" link from the confirmation e-mail or the following link and fill in the tracking number listed in your e-mail and then check the following websites to trace and track your order:

J. Notice for choosing S.F Express Service

Customers can choose to deliver their parcels from Pink Evolution to S.F. Express Service Center, EF locker and commercial/residential address when checking out. No extra cost will be charged if parcels are collected in S.F. Express Service Center. If designated S.F. Service Center is not selected, our customer service team will contact you to confirm if you wish to send the parcel to commercial/residential address. Customers may need to pay the extra fee.

We kindly advise you to contact S.F. Express or go to their website in advance to know their actual opening hours of different S.F. Service Center.(Note: Please note that addresses and opening hours of S.F. Express Service Center are subject to the change without notice.)

Please follow the following steps to collect your parcel when using self-pickup service by S.F. Express:

•When your order is being delivered, a tracking number will be provided. Please track the parcel to see if it has arrived the selected service center.

•S.F. Express may contact you by phone or SMS.

•Please collect the parcel within 3 days or it may be returned to Pink Evolution.

K. Confirmation E-mail

After making an order, a confirmation e-mail will be sent to you by our system to notify you that we will soon process your order and deliver the goods. 11. Refund

Pink Evolution return and refund policy

A. Goods returns

We accept products sold by Pink Evolution with not more than 14 days of receipt (based on the delivery record).

B. Non-returnable items

We do not accept returns of certain products, including:

•  Any product that is returned more than 14 days after receipt.

•  Any product that has been opened or used which means being (taken out of its original packaging).

•  Any product that is not in its original condition, is damaged, or is incomplete parts.

•  Any discount, clearance or sales product that Pink Evolution has already stated are non-returnable.

•  Any free gift product and samples.

•  In the event of any dispute, the decision of Pink Evolution shall be final and conclusive.

C. Return procedures

You can pack and send your return to us by the following steps:

I. Please download the Order Return Form from Pink Evolution website and fill in the required information.

II. Please contact out Customer Service Team and submit us the form via email: [email protected] or WhatsApp. We will send you an acknowledgement email after finishing progress of your request.

III. Pack the returned products along with our acknowledgement email and original invoice securely. 

IV. Send the returning items by mail or in person to: [Pink Evolution Order returns], Unit 05, 4/F, Kinglet Industrial Building, 21-23 Shing Wan Road, Tai Wai, N.T., HK, (For your protection we highly recommend that you use a tracked delivery service as we cannot be held responsible for goods not received.)

V. All return shipping fee must be paid by customers.


D. Refund policy

Please note that before providing a refund for any returned product we will first verify its condition. All Non-returnable items will neither receive refund nor return to you.

We will notify you the status of your return as soon as we received and inspected the products.

We regret that we do not refund the original shipping and handling fees with the return. We can only refund the total value of products. And if your order was placed with a promotion code or free gift, you must return them together in order to have the refund. Otherwise, the original price of the product will be deducted from the refund.


E. Refund timeline

Refund will be issued to the same account holder and in the same form of payment which is originally used for purchase.

Cash refund is not available at present, for payment by using Direct Deposit, refund will be issued by cheque in Hong Kong dollar.

12. Title

All risks in the product(s) shall pass to you upon delivery but Pink Evolution shall retain the title in the products until full payment has been received.

13. Force Majeure

If the performance by Pink Evolution of its obligations relating to the services it supplies on this site is prevented by the reason of "force majeure" (which shall include the  preventions occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of the Government of the Hong Kong Special Administrative Region or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of Pink Evolution), Pink Evolution shall be excused from such performance to the extent of such prevention.

14. Disclaimer

The company and its employees, contractors and any third party provider (collectively " Pink Evolution") make no representation or warranty in relation to:

(i) the completeness, quality, operation, use, accuracy, or timeliness of, or the fitness or use for any purpose of, Pink Evolution or the information (the “Information”) stored on or receivable through this or any other Pink Evolution server;

(ii) any goods or services accessed, offered or obtained through Pink Evolution or pursuant to the Information;

(iii) the access toPink Evolution or the Information will be uninterrupted or does not contain any viruses, or contaminating or destructive properties.

You shall not rely on the Information. Pink Evolution shall not be liable for any damages, loss, costs or expenses arises, directly or indirectly, from your reliance or use (whether authorized or not) of the Information or this website.

15. Indemnity and Waiver

At our request, you agree to compensate us fully and hold us, Pink Evolution (including its officers, directors, agents, affiliates, licensors, and suppliers), harmless from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the TOS (Term of services) by you. This includes the use of the Site by any other persons caused by your action or inaction when using your account.

If you breach the TOS and we take no action against you, it is no waiver for us to exercise our rights and remedies in any other situation where you breach the TOS.
